Land O' Lakes Man Found Guilty Of Defrauding Medicare Of $2.2 Million


A Land o' Lakes man was convicted by a Federal grand jury last week on charges that his medical marketing company paid bribes to Miami medical clinics in exchange for DNA swabs obtained from Medicare beneficiaries.

Investigators say the 49-year-old man's company began to pay a clinical laboratory company cash kickbacks and bribes for DNA swabs from Medicare beneficiaries in late 2013. They say he paid the firm for every DNA swab they sent him, and he directed the company to obtain such swabs from Medicare beneficiaries whether medically necessary or not.

The scheme allegedly ran through the following spring, at which point he began to create shell companies that handled fraudulent kickback payments, receipt of fraudulent proceeds, and transfers of illegally-obtained DNA swabs. In addition, investigators say he journeyed to several banks and ATMs in order to make multiple, smaller withdrawals of the fraudulent proceeds in order to avoid triggering mandatory reporting requirements.

The scheme came to a sudden end when the defendant was arrested on other charges in late 2014. Investigators say the entire scheme netted him $2.2 million in illegal bribes and kickbacks.

The defendant was convicted in 2015 of a litany of health care fraud, money laundering, and identity theft charges that were not related to the above allegations, for which he is currently serving a 14-year prison sentence. He was convicted by a Federal jury last week in the chambers of U.S. District Judge Susan C. Bucklew of the Middle District of Florida of one count of conspiracy to pay health care kickbacks and one count of structuring currency transactions to avoid reporting requirements. His sentencing is scheduled for early October.
