What happens after you're arrested for a DUI?

If you are arrested for a DUI, one of the things you may have to worry about is being taken to the police station and booked. Something that can help you understand what to do is better understanding the situation and what to expect.

When you're arrested for a DUI, you'll be taken to a police station and searched. Your property is taken and inventoried, keeping it safe while you're in custody. You'll be asked intake questions, but you can ask to speak with your attorney before answering questions about your mental health, medications or overall physical health if you wish.

What happens after your intake interview?

The officer will likely discuss the driver's license suspension procedure and then start a 20-minute observational period. You can ask for your attorney at any time and may not wish to say anything else until you get a chance to speak with them. It's not until after the observation period that most officers read your Miranda rights, but anything you say at any point could be used against you, so be cautious. You are legally able to refuse the post-Miranda rights interview or to wait to give the interview until your attorney is present.

Finally, you'll go through the booking system. Your identity, along with information on the arrest, is entered into a computer with your photograph and fingerprints. At this time, you get the opportunity to call family or friends to pay your bond and get you out of jail.
