Pasco Traffic Stop Ends in DUI and Battery Charges

An early morning Port Richey traffic stop last Tuesday ended with the arrest of three people, two charges of battery on deputies and one DUI charge.

Pasco County deputies stopped David Schumaker near Cochise Lane and Sandalwood Drive at about 1:50 a.m.. He, his brother Donald and Donald's wife Kelli had reportedly just left Hurricanes Sports Bar, according to a Pasco County Sheriff's Office report. Deputies said the car was weaving, failing to maintain its lane.

When they stopped the car, they discovered that the driver. David Schumaker, was driving with a suspended license. Deputies also felt he was intoxicated.

As they handcuffed David Schumaker, deputies allegedly heard yelling from inside the car.

David Schumaker's sister-in-law, Kelli Schumaker, reportedly tried to open the driver's side door of the Ford Mustang. A deputy put his hand up and told her not to get out. According to the deputies, she refused that direction, stepped out of the car and slapped his hand away.

The deputy "immediately grabbed the arrestee and guided her to the grass," the report said. While the deputy was handcuffing Kelli Schumaker, they heard more noise from inside the car.

"Oh no you don't," Kelli Schumaker's husband (David Schumaker's brother), Donald Schumaker, reportedly told deputies. According to the police report, a deputy told Donald Schumaker to stay in the car, but he kicked the passenger door open, hitting the deputy's knees. He was then taken to the ground and arrested.

Donald Schumaker was charged with battery on a law enforcement officer. Kelli Schumaker was also charged with battery on a law enforcement officer as well as with resisting an officer without violence. The report indicates that Kelli Schumaker's blood-alcohol level was recorded at 0.326, which is more than four times the level at which Florida law presumes someone is intoxicated. David Schumaker was charged with driving under the influence and driving with a suspended license.
